The petitioner is in custody in connection with Pawana P.S. Case No. 53 of 2018 for the offences under Sections 353 of the Indian Penal Code and Section 25(1-b)a, 26, 29, 30, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 08.09.2018. He further submits that in the instant case one double barrel gun and 12 cartridges were recovered from the possession of the petitioner. He submits that similarly circumstanced co-accused namely Ashok Singh @ Mahanth Singh has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 2852 of 2019 vide order dated 22.01.2019.

No.1174 of 2019(2) dt.04-02-2019 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Judicial Magistrate, Bhojpur at Ara in connection with Pawana P.S.
