2. The petitioner is in custody in connection with Sahodra P.S. Case No.54 of 2023 registered for an offence punishable under Sections 341, 323, 324, 325 and 307/34 of the Indian Penal Code.
3. As per allegation in the FIR, petitioner and other co-accused surrounded the informant and his son and started assaulting them by fist and slaps.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and there is general and omnibus allegation against him and no eye witness to the alleged occurrence and only the informant is an eye
Patna High Court CR. MISC. No.10328 of 2024(2) dt.21-02-2024 2/2 witness of the alleged occurrence as stated in para-9 of the petition. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 18.07.2023.
5. Learned APP for the State opposes the prayer for regular bail of the petitioner.
6. Considering the aforesaid facts and submission made on behalf of the petitioner, the prayer for regular bail of the petitioner is allowed. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Bettiah, District-West Champaran/concerned Court in connection with Sahodra P.S.
