JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 13.01.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner is in jail custody since 14.11.2014 in a case registered under section 364/34 of the IPC. Admittedly, victim has already returned to his home and made statement under section 164 Cr.P.C. No doubt, victim stated that he was kidnapped and forced to marry with the daughter of the petitioner but submission on behalf of the petitioner is that marriage was solemnized with the consent of victim and moreover, daughter of the petitioner has already filed matrimonial case against her husband.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be

Patna High Court Cr.Misc. No.1047 of 2015 (2) dt.13-01-2015 released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Jehanabad in Parasbigha P.S. Case no. 65/2014.
