JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is languishing in custody since 13.07.2018 in connection with Mojahidpur P.S. Case No.12 of 2017 (G.R. No.326/2017) registered for the offences punishable under Sections 394, 411 of the Indian Penal Code. Prosecution case as per the FIR is that on 29.01.2017, the informant left his house for Patna and at about 10.00 P.M., on the way at Bounsi road near the Axis Bank, three miscreants on a motorcycle arrived there and started assaulting and also took away his mobile phone, Bank ATMs of SBI and Allahabad bank, one credit card and cash amount of Rs.3500/-. It is submitted by learned counsel for the petitioner that the recovery has not been made from the petitioner.

Patna High Court Cr.Misc. No.1799 of 2019(2) dt.15-01-2019 2/2 Petitioner is accused in six other cases and three criminal cases for the offence under Sections, 399, 402, 412 of the IPC and under Section 25(1-b)a, 26, 35 of the Arms Act are pending against the petitioner.

Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur P.S. Case No.12 of 2017 (G.R. No.326/2017). The Court below will be at liberty to cancel the bail bond of the petitioner, if similar nature of offence is committed by the petitioner.
