JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-09-2021 Heard Mr. Bimlesh Kumar Pandey, learned Advocate for the petitioner and Mr. Amarendra Nath Verma for the informant. The State is represented by Mr. Syed Eheshamuddin, learned APP for the State. The petitioner, who is the husband of opposite party no. 3, seeks bail in anticipation of his arrest in connection with Bettiah (Town) P.S. Case No. 547 of 2019 dated 23.07.2019 in which cognizance has been taken under Sections 341, 342, 323, 498A, 504 and 506 of the Indian Penal Code, Section 3/4 of the Dowry Prohibition Act and under Section 67(A) of the I.T. Act.
Patna High Court CR. MISC. No.4357 of 2020(3) dt.27-09-2021 2/2 Both the counsel for the parties have stated in unison before this Court that there has been a settlement of all matrimonial dispute. The opposite parties no. 2 and 3 do not wish to prosecute the petitioner any further.
Considering the afore-noted fact, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Town) P.S. Case No. 547 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
