JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 16.9.2014 in a case registered for the offences punishable under Sections 363,366A and 498A/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has stated that she of her own went in the company of the petitioner to Banglore where she got her age recorded as 16 years whereas the court assessed her age as 13 years though as per medical opinion the petitioner is aged 16 years. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.3221 of 2015 (2) dt.27-01-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Budduchak P.S. Case No.21 of 2014.
