Mr. Amit Kumar Rakesh ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 The petitioner apprehends his arrest in connection with Complaint Case No. 3018 of 2017 registered under Sections 498A of the Indian penal Code.
Allegation against the petitioner is of subjecting to cruelty with respect to demand of dowry.
Submission of learned counsel for the petitioner is that petitioner is ready to keep his wife however, O.P. No. 2 has refused to live with him and she was assaulted earlier. She prayed that some maintenance amount may be granted to her. It appears that petitioner is working in a hotel in Delhi and according to him he has been getting salary of Rs. 20,000/- to 22,000/- per month.
Patna High Court CR. MISC. No.1911 of 2019(3) dt.28-02-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, the provisional bail granted to the petitioner is confirmed with condition that he shall pay Rs. 5000/- per month to the O.P.No. 2 as maintenance amount till she files maintenance case before the appropriate court and any interim or final order is passed in that.
It is needless to say that petitioner will have to co-operate in disposal of the maintenance case, if filed by the O.P.No. 2. Accordingly, this application stands disposed of. (Vinod Kumar Sinha, J) sujit/- U T
