Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191, 126(2), 115(2), 109, 303(2), 352 of the B.N.S. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that Munna was taking his cart in a hurry, on which the father-in-law of the informant asked him to go slow as his grandson narrowly escaped an accident by cart, on which it is alleged that Munna at 11 am came back with the accused persons and assaulted her and her family members. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the

Patna High Court CR. MISC. No.4331 of 2025(2) dt.12-02-2025 2/2 informant and from perusal of allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against any of the accused except the fact that the petitioner was driving his cart in a hurry.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Koilwar P.S. Case No. 400 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
