JUSTICE RAKESH KUMAR ORAL ORDER 11-04-2016 Heard Sri Gagandeo Yadav, learned counsel for the petitioner and Sri Damodar Prasad Tiwari, learned AP.P. The petitioner, who is in custody only since 10.6.2015 in connection with Saharghat P.S. Case No. 45 of 2015 registered for the offence punishable under Section 302 and 34 of the Indian Penal Code corresponding to Sessions Trial No. 321 of 2015 has prayed for grant of bail.

Learned counsel for the petitioner submits that in the F.I.R. he was not named as accused and falsely he has been implicated whereas learned A.P.P. opposing the prayer for bail submits that in F.I.R. he was disclosed as son of Mr. Tahir Laheri and during investigation witnesses have supported the prosecution case. He has specifically referred to paragraph no. 20 and 21 of the case diary.

I do not find any ground to extend the privilege of bail to the petitioner.

The petition stands dismissed.
