The appellants seek anticipatory bail in connection with A.B.P. No. 2217 of 2018 and in Samastipur P.S.Case No. 13 of 2016, registered for offences punishable under Sections 448, 341, 323, 354, 379, 427 and Section 3(1) (x) of the SC/ST Act.
The allegation against the appellant no.1 is of catch hold of the informant and other accused persons abused and calling her caste name and tried to outrage her modesty. Submission of the learned counsel for the appellants is that they have falsely been implicated in this case and the present case is counter blast of the earlier case, lodged by the appellant No. 3 in which notices were issued to the
Patna High Court CR. APP (SJ) No.240 of 2019(2) dt.06-02-2019 2/2 complainant and there is no any specific allegation against the appellant No. 2. It is further submitted that the appellants have no criminal antecedent.

Having heard both sides, considering the facts and circumstances of the case, this appeal is allowed and the impugned order is set aside, let the appellants, above named, in thie event of their arrest or surrender before the learned court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Samastipur in A.B.P. No. 2217 of 2108 and in Samastipur SC/ST P. S. Case No. 13 of 2016, subject to condition as laid down under Section 438 of Cr.P.C. (Vinod Kumar Sinha, J) sudha/- U T
