JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 23.9.2014 in a case registered for the offences punishable under Sections 147,324,326 and 307/34 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that four accused persons including the petitioner resorted to firing. Though in the FIR it is alleged that firing resorted caused injury on the thigh of the informant but the injury report reflects the injury on knee.
It is submitted by learned counsel for the petitioner that all the five injuries have been found to be superficial simple in nature. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the case lodged by the petitioner's side is earlier in point of
Patna High Court Cr.Misc. No.1674 of 2015 (2) dt.15-01-2015 2/2 time.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 62 of 2014.
