JUSTICE SHIVAJI PANDEY ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Informant. The present application has been filed for grant bail in connection with Sessions Trial No. 113 of 2010 arising out of Udwant Nagar P.S. Case No.72 of 2009 for offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner has moved before this Court earlier in Cr. Misc. No. 9243 of 2014. Learned counsel for the petitioner submits that two witnesses have been examined and four witnesses are still to be examined.

The trial court is directed to conclude the trial of the petitioner in connection with Sessions Trial No. 113 of 2010 arising out of Udwant Nagar P.S. Case No. 72 of 2009 within a

Patna High Court Cr.Misc. No.11722 of 2016 (3) dt.27-04-2016 period of six months from the date of receipt/production of a copy of this order subject to the condition that the petitioner will cooperate in the proceeding before the trial court. If the petitioner does not cooperate in the trial, the time ceiling will not be applicable.

If the trial is not concluded with the aforesaid period of six months, the petitioner will be at liberty to renew his prayer for bail. At the same time, the prosecution is also directed to produce all the witnesses without any delay.

Let a copy of this order be sent to the Senior Superintendent of Police, Bhojpur at Ara.
