JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is languishing in custody since 19.10.2018 in connection with Kahalgaon P.S. Case No.648 of 2018 registered under Sections 188, 290 of the Indian Penal Code and Sections 30(a), 56(d) (e) of the Bihar Prohibition & Excise Act, 2016.
Prosecution case as per the written report is that on 18.10.2018 about 7.15 P.M., the informant was directed to conduct a raid by the superior authority. After raiding on the house, a Tata Indigo car parked next to the house of the petitioner Royal Stag Premier whiskey of 375 ml each 24 bottles and in a plastic bag, five bottles containing 375 ml each and half
Patna High Court Cr.Misc. No.1809 of 2019(2) dt.15-01-2019 2/2 bottle Royal Stag Primer whiskey, made in Haryana and 29 bottles containing 750 ml each liquor were recovered. Learned counsel for the petitioner submits that the recovery has been made from joint family house. Statement has been made in para 3 that the petitioner has no criminal antecedent.
Considering the nature of accusation and the fact that recovery has been made from the joint house of the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge-cum-Special Judge, Excise, Bhagalpur in connection with Kahalgaon P.S. Case No.648 of 2018.
