This application is for grant of regular bail in connection with Belaganj P.S.Case no.52 of 2015 for the offences under Sections 147, 148, 149, 341, 447, 323, 325 , 307 and 302 of the Indian Penal Code.

Petitioner is named in the FIR including several other accused persons and it is stated that they have assaulted by lathi and danda to the father of the informant, due to which he succumbed to the injuries. It further appears that the case is of the year, 2015 . He is named in the FIR but he has apprehended/surrendered on 11.11.2019.

Submission of the learned counsel for the petitioner is that the allegations are general in nature and considering the same one of the co-accused has been granted

Patna High Court CR. MISC. No.3559 of 2020(2) dt.31-01-2020 2/2 bail vide order dated 29.3.2016 passed in Cr. Misc. No.4444 of 2016 and the case is still under investigation. Heard learned A.P.P. , wh has opposed the prayer for bail..

Having heard both sides and in view of submissions as made above, at this stage, I am not inclined to grant bail to the petitioner, however, once the charge is framed int his case, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
