JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 16.6.2018, seeks bail in connection with Jagdishpur P.S. Case No. 204 of 2018 registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
Petitioner happens to be the husband of informant's daughter and, according to the prosecution case itself, the marriage of informant's daughter solemnized with petitioner 12 years back and the informant's daughter led her conjugal life with petitioner near about 12 years and gave birth to a female child.
Initially, the case was registered under Sections
Patna High Court CR. MISC. No.1525 of 2019(3) dt.28-03-2019 2/2 302/201/34 of the Indian Penal Code but after due investigation, police submitted charge-sheet for the offences punishable under Section 306/201/34 of the Indian Penal Code. The perusal of case diary goes to show that in course of investigation, the Investigating Officer recorded the statements of independent witnesses vide paragraph 30, 31, 33 and 34 and all the aforesaid witnesses stated that informant's daughter was a short tempered lady and on account of petty dispute, she committed suicide along with her child. Considering the aforesaid facts and circumstances as well as submissions of the parties, Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XI, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 204/2018.
