Petitioner apprehends arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner, who is mother-in-law of the deceased, has falsely been implicated in this case. He submits that the petitioner resides separately from the husband of the deceased and similarly situated co-accused Bijendra Sao and Shambhu Sao have already been allowed pre-arrest bail by different benches of this Court vide orders dated 14.3.2019 and 9.4.2019, passed in Cr.Mis.No. 20595/2019 and 26150/2019.
Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Barh, Patna in Athmalgola Police Station Case No.
Patna High Court CR. MISC. No.1553 of 2020(2) dt.24-02-2020 2/2 214 of 2018, on the following conditions:-
(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on her absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
