The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 325, 307, 302 and 504/34 of the Indian Penal Code.

The allegation against the petitioner and others is to have assaulted Shabir Miyan and Habib Miyan, who succumbed to their injuries.

Considering the allegation and the order dated 22.5.2014, I do not find any new ground to grant bail to the petitioners. Prayer for bail is rejected.

Let the trial of the petitioner in Sessions Trial no. 209 of 2014 arising out of Baniyapur P. S. Case no. 274 of 2013 be expedited.

Vide order dated 8.4.2015 passed in Cr. Misc. no.

Patna High Court Cr.Misc. No.35569 of 2015 (2) dt.05-08-2015 2 / 2 50280 of 2014 it appears that learned trial court has expected to conclude the trial within a period of six months. If the trial is not concluded with the aforesaid period, it will be open to the petitioner to move the trial court for grant of bail.
