The petitioners are apprehending their arrest in connection with Dhanaha P.S.Case no.201 of 2018 , registered for offences punishable under Sections 147, 148, 149, 307, 323, 324, 341, 342, 325, 379, 447, 448, 504 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and others and specific allegation against the petitioner nos. 4 and 5 is of assault by Farsa.
Patna High Court Cr.Misc. No.1592 of 2019(2) dt.23-01-2019 2/2 Submission of the learned counsel for the petitioners is that there is case and counter case and no specific allegation has been attributed against any of the petitioners except petitioner nos. 4 and 5 and there is delay in lodging of FIR. Moreover the injuries are simple in nature, which will appear from annexure 3 series.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Ist, Bagaha, West Champaran (Bettiah) in connection with Dhanaha P.S.Case no.201 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
