JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 30.9.2015 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

From the house and wooden shop of the petitioner 4.510 kilograms of ganja were recovered.

It is submitted by the learned counsel for the petitioner that the petitioner was not present at the shop. The alleged shop was run by co accused Mithu Kumar who was apprehended on spot. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, the investigation has already concluded.
