JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2019 The present application has been filed for modification of order dated 09.07.2015 passed in Criminal Miscellaneous No. 23767 of 2015 to the extent of extending the period of surrender.

It is submitted by learned counsel for the petitioner that the petitioner is a disabled person and hence, he could not surrender before the learned Court below within the stipulated time.

Considering the grounds mentioned in the modification application, the period of surrender is extended by four weeks from the date of receipt/production of a copy of this order in connection with Dehri (T) P.S. Case No. 122 of 2014, pending in the Court of learned Sub-divisional Judicial

Patna High Court CR. MISC. No.1633 of 2019(2) dt.08-05-2019 2/2 Magistrate, Dehri, Rohtas, if the petitioner files an affidavit to the effect that between the period of grant of bail and surrender, the petitioner has not been made accused in another case. In the circumstances, the order dated 09.07.2015 passed in Criminal Miscellaneous No. 23767 of 2015 is modified to the extent indicated above.
