The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 3(a) RP (UP) Act.

The prosecution case is that the informant being the RPF police personnel received information that the miscreants are unloading rice bags at Lahaban Railway Station from the wagon of the goods train. When the informant reached along with the police personnel the miscreants started fleeing away when Lutan Hazra and Rohan Paswan were arrested and from them five bags of 50 kgs. each rice unloaded from the

Patna High Court Cr.Misc. No.7053 of 2016 (2) dt.16-02-2016 2/2 wagon of the goods train were recovered. The apprehended accused suggested the name of the petitioners and others. It is submitted by learned counsel for the petitioners that except the confession of the apprehended accused there is nothing against the petitioner. There is no recovery from the petitioners and a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with RPF Post Jasidih Case No. 01 of 2015 pending in the court of learned Railway Judicial Magistrate, Kiul.

With the aforesaid observation, this application is disposed of.
