The petitioner seeks bail in Chautham P.S. Case No.175 of 2019, registered under Sections 25(1-b) a, 26 and 35 of the Arms Act.

The police apprehended the petitioner and others and on search one country made pistol and nine cartridges were recovered from possession of the petitioner.

Learned counsel for the petitioner submits that only one country made pistol and nine cartridges have been recovered and for that the petitioner is in jail since 06.08.2019. Similarly situated co-accused, namely, Ramesh Yadav @ Lambu @ Lamboo has been granted bail by a coordinate Bench of this Court vide order dated 17.12.2019, passed in Cr. Misc.

Patna High Court CR. MISC. No.3795 of 2020(5) dt.09-06-2020 2/2 No.83691 of 2019. Against Ramesh Yadav many criminal cases were pending and this fact was taken note by the Hon'ble Judge while granting bail. The case of the petitioner stands on better footing so far as the criminal antecedent is concerned. The petitioner is accused in only five criminal cases and he is in custody for last ten months.

Considering the facts that similarly situated coaccused, namely, Ramesh Yadav @ Lambu @ Lamboo was granted bail by a coordinate Bench of this Court vide order dated 17.12.2019, passed in Cr. Misc. No.83691 of 2019 and the petitioner is in jail for the last ten months for recovery of one country made pistol and nine cartridges, petitioner, namely, Pawandeo Yadav @ Ghoghal Yadav is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S.
