The petitioner seeks bail in a case for the offences punishable under sections 25 (1-B) a and 26 (ii) of the Arms Act. For the alleged recovery of one loaded country made pistol and three more live cartridges the petitioner was apprehended on 06.11.2015.
Submission is of false implication and that nothing has been recovered from conscious possession of the petitioner and he has got no criminal antecedent and as such he deserves sympathetic consideration, to which the learned A.P.P. opposes. In the facts and circumstances as stated above, the petitioner shall be released on bail, after completion of six
Patna High Court Cr.Misc. No.6496 of 2016 (3) dt.03-05-2016 2/2 months in custody from the date of his remand, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Sheikhpura in Sheikhpura (Hathiyama) P.S. Case No. 352 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
