This is an application for grant of regular bail filed on behalf of the petitioners. Petitioners are in custody in connection with Bhaptiyahi PS Case No. 82 of 2018 for the alleged offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504, 447 and later on under Section 302 of the Indian Penal Code. Learned counsel representing the petitioner submits that in the instant case 28 persons have been named as aggressor causing injury to the victim who died during the course of treatment in hospital. Learned counsel for the petitioners submits that petitioners have no criminal antecedent and they are in custody since 14.09.2018. He further submits that
Patna High Court Cr.Misc. No.1944 of 2019(2) dt.17-01-2019 2/2 considering the omnibus nature of allegation, vide Annexure-3 series, similarly circumstanced co-accused have been granted bail by co-ordinate Benches of this Court in Cr. Misc. No. 68485 of 2018 and Cr. Misc. No. 71799 of 2018. Considering the aforesaid fact situation, this application is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Bhaptiyahi PS Case No. 82 of 2018.
