JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 10.11.2014 in a case registered for the offences punishable under Sections 406,420 and 506/34 of the Indian Penal Code. It is alleged that the informant kept Rs.2,14000/- for the purpose of marriage of his daughter which was invested in a chit fund company run by the petitioner who gave assurance that the informant will get one and half time of the invested amount within one year but neither the principal nor the maturity amount was returned.

It is submitted by the learned counsel for the petitioner that since the informant was on inimical terms with Nesar who filed a case against the informant at earlier point of time and

Patna High Court Cr.Misc. No.1672 of 2015 (3) dt.16-01-2015 2/2 petitioner is the nephew of Nesar. It is further submitted that the petitioner has no concern with the chit fund company. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Rafiganj P.S. Case No.133 of 2014.
