The appeal has already been dismissed against respondent Nos. 1 to 13 and 15 to 29 for non compliance of the peremptory order. Learned counsel, Mr. R.K. Diwedi, appearing on behalf of the appellant submitted that in spite of repeated letters and communication, the appellant is not responding to him, therefore, he is unable to take any step.

It appears that the first appeal arises out of the partition suit filed by the plaintiff has been dismissed on the contest of the defendants-respondents.

In view of the facts, the appeal has become incompetent, accordingly, the appeal itself is dismissed. (Mungeshwar Sahoo, J) brajesh/- U
