JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Routa P.S. Case No. 41 of 2016 registered for the offences punishable under Section 379 of the Indian Penal Code.
Allegation is of theft of Mobile phone and later on from CDR location it appears that the same was used by the petitioner.
Submission of learned counsel for the petitioner is that he is a bonafide purchaser of the mobile phone and he has no knowledge that the same is stolen one.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this
Patna High Court Cr.Misc. No.300 of 2019(4) dt.14-02-2019 2/2 order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Purnea, in connection with Routa P.S. Case No. 41 of 2016, corresponding to G.R.No. 2557 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
