JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 24.11.2015 in a case registered for the offences punishable under Sections 25(1B)a, 26 and 35 of the Arms Act and 20 and 22 of the NDPS Act. From the vehicle which was being driven by the petitioner, 2.50 gram of ganja and cartoon of country made liquor were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is the driver of a public carrier. The vehicle in question was hired by co-villager of the petitioner namely Sanjay and the recovered articles were of Sanjay. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, investigation has already concluded.

No.7092 of 2016 (3) dt.03-03-2016 2/2 Considering the recovery of small quantity and the investigation being concluded, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Patna in connection with Special Case No. 44 of 2015 arising out of Danapur P.S. Case No. 653 of 2015.
