Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 353, 307 of the Indian Penal Code and 25(1-B)A 26, 27 of Arms Act and 37(1)(2) of Bihar Prohibition and Excise Act 2016.

Petitioner is said to have shown pistol to the informant and police officials when he is in inebriated condition. However, two pistols and cartridges were recovered from conscious possession of the petitioner.

Para- 3 of the supplementary affidavit goes to show that prior to institution of the present case, the petitioner was

Patna High Court Cr.Misc. No.223 of 2019(2) dt.17-01-2019 2/2 made accused in two other cases. However, it is informed that out of the aforesaid two cases, petitioner has already been acquitted in one case whereas trial in respect of the other case is still pending.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the charge sheet in the present case has already been submitted, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI cum Special Judge, Excise, Kaimur at Bhabhua in connection with Excise Case No. 852 of 2018 arising out of Bhabhua P.S.Case No. 682 of 2018.
