The petitioner seeks regular bail in Kurdhni (Turki O.P.) P.S. Case No. 418/2018, registered for the offences punishable under Section 394 and 302 of the Indian Penal Code. Later on, section 414 of the Indian Penal Code was added. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade (TIP) has been held. Name of this petitioner has come in the confessional statement of Sujit Kumar and Basant Kumar which also find mentioned in the impugned order. Petitioner is in custody since 31.08.2018 having clean antecedent.

Patna High Court Cr.Misc. No.163 of 2019(2) dt.18-01-2019 2/2 Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate -3rd, Muzaffarpur (West) in connection with Kurdhni (Turki O.P.) P.S. Case No. 418/2018, subject to the condition that both the bailors will be close relative of the petitioner.
