The petitioner seeks regular bail in Gopalpur P.S. Case No. 04 of 2014 (S.T. No. 542 of 2014), registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code as well as Section 27 of the Arms Act. The informant alleged that he heard sound of firing and saw many persons going on three motorcycles. Immediately, thereafter the informant named the petitioner as one of pillion riders. After sometime he saw his son lying in injured condition and his son said to have disclosed that Girishba got him killed and Monbodh Sah is also instrumental who exhorted to kill Anil Mishra.
It is submitted that nobody has seen the occurrence. Manbodh Sah was granted bail vide order passed in
Patna High Court Cr.Misc. No.2190 of 2015 (2) dt.19-01-2015 Cr. Misc. No. 33811 of 2014. Girish Lal was granted bail vide order passed in Cr. Misc. No. 28354 of 2014. Sukhen Sah has been granted bail vide order passed in Cr. Misc. No. 19734 of 2014. The case of the petitioner stands on the same footing and petitioner is in jail since 13.01.2014.
Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge, West Champaran, Bettiah in connection with Sessions Trial No. 542 of 2014 arising out of Gopalpur P.S. Case No. 04 of 2014.
