The petitioner seeks regular bail in Chowk P.S. Case No. 408/2017, registered for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade (TIP) has been held. Petitioner was arrested in Alamganj P.S. Case No. 494/2017 and thereafter he was remanded in the present case. Petitioner is in custody since 11.05.2018.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the

Patna High Court Cr.Misc. No.159 of 2019(2) dt.18-01-2019 2/2 petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City in connection with Chowk P.S. Case No. 408/2017, subject to the condition that both the bailors will be close relative of the petitioner.
