2. The petitioner seeks bail in connection with Sessions Trial No. 389 of 2024 arising out of Alauli P.S. Case No. 40 of 2024 instituted for the offences under Sections 302, 324, 326, 307 of the Indian Penal Code.

3. Accusation against the petitioner is of committing the murder of his wife by slitting her neck. It is further alleged that this petitioner also caused injuries to the two sisters of his wife.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submitted that from

Patna High Court CR. MISC. No.3691 of 2025(3) dt.23-04-2025 2/3 perusal of the FIR it appears that informant has not assigned any motive for the commission of the alleged occurrence. Learned counsel further submitted that, as a matter of fact, the informant and her family members assaulted the petitioner mercilessly and the petitioner himself sustained grievous injuries. Police, after investigation, submitted charges under Sections 302, 324 of the IPC. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.02.2024 and has one criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that there specific allegation of committing the murder of the deceased against this petitioner by slitting her neck as also of causing injuries to the two sisters of the deceased. Learned APP further submitted that post-mortem report also corroborates the allegation as levelled in the FIR.

Considering the aforesaid facts and circumstances of the case, there being specific allegation against the petitioner of committing the murder of the deceased by slitting her neck which is supported by the post-mortem report, this Court is not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer for grant of bail to the
