The petitioner has renewed his prayer for bail in connection with S.K.Puri P.S. Case No. 115 of 2014 registered under Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 10.07.2015 passed in Cr.Misc. No. 30029 of 2015, whereby an observation was made that if the trial is not concluded within six months from the date of framing of charge, the petitioner would be at liberty to renew his prayer for bail.

It is contended by the learned counsel for the

Patna High Court Cr.Misc. No.11232 of 2016 (3) dt.20-04-2016 2/2 petitioner that till date charges have not been framed. It has also been contended that similarly situated other co-accused have been granted bail by different Benches of this Court. By order dated 18.03.2016, a report was summoned from the jurisdictional Magistrate. The learned Magistrate has reported that the case is still pending for framing of charge for want of compliance with the provisions prescribed under Section 207 of the Code of Criminal Procedure.

Regard being had to the fact that the petitioner is in custody since 09.07.2014 and some other similarly circumstanced co-accused have already been granted bail by different orders passed by different Benches of this Court, the petitioner Vinod Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with S.K.Puri P.S. Case No. 115 of 2014.
