The petitioners seek bail in Forbesganj P.S. Case No. 559/2018, instituted for offences under Section(s) 147, 149, 323, 341, 354(B), 307, 380, 427, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that in the written report there is no allegation of assault against petitioner no. 1. Petitioner no. 2 is alleged to have assaulted the informant with sword causing injury on her left hand. It is further submitted that there is case and counter case between the parties. The injuries sustained by injured are found to be simple in nature.
Patna High Court Cr.Misc. No.81 of 2019(2) dt.18-01-2019 2/2 It is mentioned in para 6 of bail petition that for the same occurrence father of petitioner no. 2 has lodged Forbesganj P.S. Case No. 560/2018 against the informant and her family members.
Petitioners are in custody since 09.10.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 559/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
