The petitioner apprehends his arrest in connection with Malaypur P.S. Case No.60 of 2022, registered for the offences punishable under Sections 147, 148, 149, 307, 324 and 379 of the Indian Penal Code.

The petitioners and other co-accused persons are said to have assaulted the informant and one Bhagirath Ravidas by means of various weapons causing injuries to them. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the specific allegation is against co-accused, Pramod Das,

Patna High Court CR. MISC. No.5121 of 2023(2) dt.10-02-2023 2/2 Manoj Das, Rakesh Kumar and Kundan Kumar and the allegation against the petitioner is general and omnibus. It is submitted that similarly situated co-accused, Kundan Kumar and Ajay Kumar have already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 06.12.2022, passed in Cr. Misc. No.48143 of 2022. It is lastly submitted that the petitioner was the member of the mob. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Malaypur P.S. Case No.60 of 2022, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
