1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The matter has been placed for consideration of the petitioner's regular bail prayer in connection with Phulwari Sharif P.S. Case No. 243/2023 dated 14.02.2023 registered for the offence punishable under sections 411, 413, 414/34 of the Indian Penal Code.

3. Mr. Ranjeet Kumar Singh, learned counsel appearing for the petitioner submits that the petitioner earlier preferred Cr. Misc. No. 48274/2023 for the relief of regular bail which was rejected by this Court vide order dated 03.08.2023 and the petitioner has again come for the said relief mainly on the ground of incarceration period and no progress in his trial. No.9092 of 2024(3) dt.26-04-2024 2/2 criminal antecedent and has been languishing in jail since 16.02.2023 and one co-accused namely Pappu Kumar has already been granted bail by a co-ordinate bench of this Court vide order dated 21.07.2023 passed in Cr. Misc. No. 41297/2023.

4. Mr. Ajay Kumar Jha, learned APP for the State has opposed the bail prayer of the petitioner.

5. Considering the above submissions and mainly taking into account the petitioner's custody period, and also, no progress in his trial which gets reflected from the report sent by the trial court coupled with the petitioner's clean antecedent, this Court is now inclined to release the petitioner on bail. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in Connection with Phulwari Sharif P.S.
