JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 16.11.2014 in a case registered for the offences punishable under Sections 147,148,149,341,323,326 and 307 of the Indian Penal Code.
The specific accusation of causing fire arm injury on the informant's waist is against Rajo Gope whereas Sadhu Yadav caused fire arm injury to the uncle of the informant. It is submitted by the learned counsel for the petitioner that no specific overt act has been alleged against the petitioner and petitioner's side lodged Sare P.S. Case No. 78 of 2014 under sections 147,148,149,341,323 and 307 IPC and section 27 of the Arms Act at earlier point of time.
