The petitioner is apprehending his arrest in connection with Chiraiya P.S.Case No.375 of 2018 registered for offences punishable under Sections 341, 342, 186, 353, 332, 225B, 365, 392, 120B/34 of the Indian Penal Code.

Allegation as per FIR is that the police received information that 80 bags of black pepper each bag containing 25 kg. loaded on Bolero was intercepted and name of the petitioner was disclosed by the cleaner of the vehicle.

Submission of the learned counsel for the petitioner is that the petitioner has no criminal antecedent and he has been made accused only on the basis of information supplied by the cleaner who is also a co-accused and several persons are named. Heard learned A.P.P. also.

No.1642 of 2019(2) dt.24-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and if possible to be disposed of on the same day.

With the aforesaid observation, this application is disposed of.
