Petitioner apprehends arrest in a case registered for the offences punishable under Section 30a of the Bihar Prohibition and Excise Act.

Prosecution's case in brief is that 2 liters of country made liquor was recovered from the house of the petitioner. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case as the alleged incriminating material has not been recovered from his conscious possession. Petitioner has got no criminal antecedent. Considering the nature of allegation against the petitioner that the aforesaid recovery of illegal liquor has been made from the petitioner's house, his prayer for bail is refused with direction to surrender and seek regular bail which would be
