This Civil Miscellaneous application has been filed under Article 227 of the Constitution of India against the order dated 30.5.2018 passed by learned Principal Judge, Family Court, Bhojpur, Ara in Matrimonial Case No. 144 of 2015, whereby and whereunder the Court below has directed to pay interim maintenance of Rs. 15,000/- per month to his wife and son from the date of application and Rs. 20,000/- for legal expense and arrear amount will be paid in six equal installments on interval of every three month.
During the argument, learned counsel for the
Patna High Court C.Misc. No.1408 of 2018(8) dt.24-04-2023 2/2 petitioner submits that he may be permitted to withdraw this Miscellaneous application.
Learned counsel for the respondent submits that despite the undertaking given before this Court for making the payment of interim maintenance the petitioner failed to comply the same with mala fide to harass the respondent-wife. However, he has no objection for withdrawal of the Miscellaneous application.
In view of the submission of the learned counsel for the petitioner, this case is dismissed as withdrawn. (Sunil Dutta Mishra, J) ashutosh/- U
