The petitioner is apprehending his arrest in connection with Muffasil P.S.Case No.254 of 2018 dated 13.5.2018 registered for offences punishable under Sections 498(A), 302/34 of the Indian Penal Code bearing G.R.No.1876 of 2018. Allegation against the petitioner is of subjecting his wife of cruelty and for that panchayati was also held and killed by hanging her.
Submission of the learned counsel for the petitioner is that a compromise has been reached between the parties and the informant has filed an affidavit to the fact that in wrong impression, the present case has been filed.
Heard learned A.P.P. , who has opposed the prayer for bail
Patna High Court Cr.Misc. No.1636 of 2019(2) dt.24-01-2019 2/2 stating that the petitioner is the husband and there is allegation against him and other accused persons of subjecting her cruelty and assault..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
