====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------------- 02-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioner seeks bail in connection with Sessions Trial No.618 of 2013, arising out of Ballia P.S. Case No.95 of 2013 registered under Sections 302/34 of the Indian Penal Code. The accusation is that this petitioner and the coaccused Md. Mister dragged out the deceased from his betel shop and, thereafter, they assaulted the deceased with fists and slaps and twisted his neck. When the deceased, was being taken to the hospital for treatment, he died on the way to the hospital. Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.5989 of 2016 (3) dt.02-03-2016 2/2 submits that the co-accused Md. Mistar alias Md. Mister has already been granted bail by this Court vide order dated 13.01.2016 passed in Criminal Misc. No.47918 of 2015. The petitioner is in jail custody since 18.05.2013. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV, Begusarai, in connection with Sessions Trial No.618 of 2013, arising out of Ballia P.S. Case No.95 of 2013. Out of the two sureties, one surety must be the close relative of the petitioner.
