JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with S.Tr. No. 1171A/2009, arising out of Masaurhi P.S. Case No. 62 of 2007 for the offenses under Sections 147, 148, 149, 302, 324, 326, 307, 379, 427 IPC, Section 27 Arms Act and Section 17 of the Criminal Law Amendment Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Referring to the prosecution case he submits that there is omnibus allegation against all the 15 FIR named persons. He further submits that similarly circumstanced co-accused Chiwa Manjhi and others and Chania Manjhi have been granted bail by this Court in Cr. Misc. No. 52479 and 45713 of 2007. The petitioner was out of

Patna High Court Cr.Misc. No.1919 of 2019(2) dt.15-01-2019 2/2 State in connection with his job as labourer and as such he could not surrender on time.

Considering the totality of the fact situation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge III cum Special Judge, CBI-II, Patna in connection with S.Tr. No. 1171A/2009, arising out of Masaurhi P.S. Case No. 62 of 2007, subject to the conditions that (1) petitioner will appear on each and every date before the court below, (2) bailors shall be the family members and (3) in the event the petitioner is found absent on any date fixed by the trial court without any cogent reason, the trial court shall be at liberty to cancel the bail bonds of the petitioner.
