The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 323, 341, 307, 447, 379, 504, 34 of the Indian Penal Code.

As per allegation, the accused persons including the petitioner abused and assaulted the father and sister of the informant Arun Kumar, namely Saryug Yadav and Rina Kumari by means of lathi, sticks and iron rod and they also assaulted his brother namely, Bindu Kumar when he went to save his father and sister. The informant and his family members anyhow fled away and entered into his house then the accused persons chased and the also entered into his house and assaulted and they also took away some articles from his house. They also snatched earring and golden chain from the sister of the informant. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.2053 of 2020(2) dt.26-02-2020 2/2 petitioner has been falsely implicated in this case due to previous enmity and there is no specific allegation against the petitioner. There is general and omnibus allegation against the petitioner. The other accused have already been granted anticipatory bail by the court below. The father of the informant had lodged a case bearing Deepnagar P.S. Case No. 218/2002 against the informant and due to which present case has been lodged. There is case and counter case and the petitioner has got no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Deepnagar P.S. Case No. 282 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
