Petitioner, who is in custody, seeks bail in connection with Medni Choki P.S. Case No. 66 of 2018 registered for the offence punishable under Sections 366(A), 313, 504, 506, 34 of the Indian Penal Code.

Informant has alleged in her written complaint that petitioner had established physical relation with her for last four years and thereafter they entered into marriage on 10.06.2017 and used to live like a husband and wife, however when she went to his house she was abused by his mother and father and also threatened to be killed and she is instituted this case on 16.09.2018.

Patna High Court Cr.Misc. No.1620 of 2019(2) dt.23-01-2019 2/3 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. From reading of the written complaint, no criminal offence is made out. Informant had also instituted subsequently a case against petitioner as detailed in para 3 of this petition in which police has submitted final form. It has been further submitted that coaccused, namely, Kavita Devi and Satyanarayan Singh have been granted bail by this Hon'ble Court vide order dated 06.11.2018 passed in Cr. Misc. No. 67976 of 2018. Petitioner is in custody since 24.11.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Lakhisarai, in connection with Medni Choki P.S. Case No. 66 of 2018 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution

Patna High Court Cr.Misc. No.1620 of 2019(2) dt.23-01-2019 3/3 will be at liberty to move for cancellation of bail of the petitioner.
