JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 This is an application for grant of anticipatory bail in connection with Udwant Nagar (Gajrajganj ) P. S. Case No. 413 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per F.I.R. there is allegation of manufacturing the illicit liquor at the bank river. On seeing the police party, petitioner and other accused persons fled away from the spot and there is recovery of 110 liters of Mahua liquor. It is also alleged that the name of the petitioner and other accused persons were disclosed by the Chowkidar of the village. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent. Nothing manufacturing articles has been recovered from his possession.
Patna High Court CR. MISC. No.1682 of 2020(2) dt.14-01-2020 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail.
Having heard both sides, in view of the submission, made above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
