JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Nasriganj P.S. Case No. 183 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code. The First Information report was registered against unknown. Allegedly, some miscreants were following the pickup van, owned by a business establishment, namely, Gyatri Enterprises, in which the informant was travelling. A car, subsequently, overtook the pick-up van, made the van to stop and on the point of pistol, the accused persons took away the pick-up van, which was loaded with certain articles. The petitioner's name emerged in course of investigation. The petitioner is said to have confessed his
Patna High Court CR. MISC. No.1456 of 2020(3) dt.05-06-2020 2/2 involvement in connection with the offence.
Mr. Yogesh Chandra Verma, learned Senior Counsel, appearing on behalf of the petitioner, has submitted that as a matter of fact, the vehicle has been recovered from the possession of one Moti Sah, who has been allowed regular bail by this Court by an order dated 18.01.2020 passed in Cr. Misc. No. 86507 of 2019.
Considering the submission that the person, from whose possession the looted pick-up van was recovered, has been allowed bail, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II-cum-Sub Judge-II, Bikramganj, Rohtas, in Nasriganj P.S. Case No. 183 of 2019.
