1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Rajgir P.S. Case no.197 of 2023 registered under sections 302, 201, 120B and 34 of the Indian Penal Code.
3. As per the prosecution case, the husband of the informant was discovered dead by the local Choukidar. The informant states that her husband was having illicit affair with the wife of one Indal Rajbanshi. The FIR named accused persons had also beaten him up, however, her husband escaped. She suspects that Indal Rajbanshi, Kundan Rajbanshi and Sharifa Devi have conspired and killed him.
4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the
Patna High Court CR. MISC. No.7494 of 2024(2) dt.20-02-2024 2/2 case. He is not named in the FIR. His name transpired in the confessional statement of coaccused Indal Rajbanshi in course of investigation. The said Indal Rajbanshi has been enlarged on bail vide order dated 12.2.2024 passed in Cr. Misc. no.6274 of 2024. The petitioner is in custody since 17.4.2023 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., grant of bail to Indal Rajbanshi on whose confessional statement before the police the name of the petitioner transpired together with the petitioner having remained in custody since 17.4.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Rajgir P.S. Case no.197 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif at Nalanda.
