02. In the present case, the petitioner seeks bail in connection with Rail P.S. (Dehri-On-Sone) Case No. 10 of 2024 registered for the alleged offences under Sections 143(5) of Bharatiya Nyaya Sanhita, 2023 and Section 79 of Juvenile Justice Act.
03. As per prosecution case, police found two children in suspicious condition with the petitioner and in inquiry, they came to know that the petitioner was taking the children to Kolhapur for making them work in a motor parts factory.
04. Learned senior counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in

The petitioner has no workshop or factory at Kolhapur and it is not believable that the parents of the children would allow the petitioner to take their children for working in some factory at a far away place rather the fathers of the children have filed affidavit to the effect that their sons were going with the petitioner to visit Kolhapur and not to work there. Therefore, the petitioner has been implicated in this case merely on suspicion. Learned senior counsel further submits that moreover, the children are aged about 15 years and it is not a case of child labour. Learned senior counsel further submits that the petitioner is having clean antecedent and he is in custody since 15.10.2024. Charge-sheet has been submitted.
05. Learned APP for the State opposes the prayer for bail. Learned APP submits that the petitioner was found trafficking the children to work as child labour and he does not deserve to be enlarged on bail.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.3298 of 2025(3) dt.19-04-2025 3/3 satisfaction of learned District & Additional Sessions Judge-XV, Gaya/court concerned in connection with Rail P.S. (Dehri-OnSone) Case No. 10 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
